On Feb.4, 2010, the Illinois Supreme Court rendered its long awaited decision in the case of LeBron v. Gottlieb Memorial Hospital. The court affirmed the ruling of the Circuit Court of Cook County invalidating the legislation that capped damages in medical malpractice lawsuits. The court stated that the cap violated the Illinois constitution’s prohibition of special legislation and that the cap impermissibly entrenched on the judicial system in violation of the Separation of Powers provision. The cap would have limited a jury’s award of non-economic damages (for pain and suffering, disability, and disfigurement) to an injured patient to $500,000 v. doctors and $1,000,000 against hospitals. The Court’s decision is a huge victory for patient’s rights and reverses legislation passed by the legislature after huge lobbying efforts by the insurance industry and the medical establishment. We expect the lobbyists to flood the media with claims that all doctors will now leave the state- scare tactics that have no basis in reality.
